The regulation puts in place zero duty rates for industrial products and battery materials which are not produced in Europe to avoid market disruptions and to promote integrated battery production in the EU. The regulation targets certain CRMs, such as magnesium and phosphorus, for which a 4% and 5.5% import tariff used to be in place.
In a Fact Sheet issued by the White House today (14 May), the Administration said it would increase the tariff rate on lithium-ion batteries for electric vehicles (EVs) from 7.5% to 25% in 2024, and the tariff rate for non-EV lithium-ion batteries from 7.5% to 25% in 2026.
There are thousands of uses for imported lithium batteries. There are also hundreds of imported products that come with lithium batteries. At the moment, the U.S. does not require importers to have a license specific to battery imports. Most lithium battery regulation has to do with the shipping process.
The biggest hurdles to overcome when importing lithium batteries, or any product, from China are: Following a new set of tariffs announced by the Biden Administration in May 2024, the duty rate on lithium-ion EV batteries was raised from 7.5% to 25%, and non-EV batteries will raise to 25% in 2026.

You can also use our HS Lookup tool to get the full length HS code for your lithium-ion battery.
The White House implied that the latest increase in tariffs would ensure those investments are protected and can continue as planned. Currently, the US gets most of its lithium-ion batteries from China, but only a small portion of these batteries are for use in EVs.
