The Commission proposal was adopted in parallel to a delegated act, aligning the revision of the Mercury Regulation with decisions taken by the fourth Conference of Parties (COP4) of the Minamata Convention.
Button cell batteries can contain 0-25 mg of mercury (and sometimes more). Lithium miniature batteries contain no intentionally-added mercury. However, small amounts of mercury are still added to most zinc air, alkaline and silver oxide miniature batteries in order to prevent the formation of internal gases that can cause leakage.
The prohibition of the manufacture, export and import of Batteries or accumulators that contain more than 0,0005 % of mercury by weight, after 31.12.2020, is covered by the Mercury Regulation (EU) 2017/852 which complements a large body of existing EU environmental law on mercury.
Hence, Article 20 of the Mercury Regulation establishes the legal basis for this Delegated Regulation. The Minamata Convention entered into force on 16 August 2017 and has to date been ratified by the European Union 7 and 136 countries, including all the EU Member States.
EU Directive 2006/66/EC on batteries and accumulators and waste batteries and accumulators, prohibits the placing on the market all batteries or accumulators, whether or not incorporated into appliances, that contain more than 0,0005 % of mercury by weight. The directive was adopted in 2006 and has been subject to a number of revisions.
