If lithium-ion batteries are comprised of toxic chemicals under EPCRA 313 (Toxics Release Inventory) [40 CFR 372.65], reporting may be required to the Toxics Release Inventory (EPCRA Section 313). What is the Consumer Product Exemption and how does it apply to lithium-ion batteries?
A facility has few lead-acid batteries (non-consumer type) on site. How does the facility report these batteries on the Tier II form? The facility must first determine if there are any hazardous chemicals or extremely hazardous substances (EHSs) in the batteries. Most batteries contain sulfuric acid, an EHS, and then some non-EHSs.
The 2011 guidance document for lead-acid battery reporting stated the basis for this determination is, “The quantity of electrolyte, which is the component of the battery which presents the primary immediate hazard to emergency responders, should be used to determine if the batteries have exceeded the reporting threshold”.
Therefore, the reporting threshold for lithium-ion batteries (at the federal level) is 10,000 pounds. At a state and local level, reporting thresholds are more complex in that they vary among states and even counties and local jurisdictions.
If a battery contains molten metal, HSC defines specific reporting in 25507(a)(8)(C) and states that reporting is required for a, “combustible metal, or metal alloy, that poses an explosive potential, when in molten form, in a quantity at any one time during the reporting year that is equal to, or greater than, 500 pounds”.
All other large commercial type lithium-ion batteries stored in a facility are not exempt and should be included in a Tier II report. For example: Report batteries that are used to power forklifts, because these batteries are not sold for use by the general public.
