On 10 December 2020, the European Commission published its proposal on the new Batteries Regulation, which replaces the current Batteries Directive (2006/66/EC). This is a long-awaited and crucial piece of legislation, defining the legislative framework for our industry for the next 15 years.
A battery producer is defined by the regulation as an importer, manufacturer, distributor, or other legal person that either: a. Is established in the EU, and manufactures batteries in the EU under its own name b. Is established in the EU, and has batteries manufactured under its own name to sell them in the EU c.
Battery cells or battery modules made available for end use without further incorporation or assembly into larger battery packs or batteries will be regarded as batteries under the regulation, subject to the requirements for the most similar battery category.
Labelling requirements will apply from 2026 and the QR code from 2027. The regulation amends Directive 2008/98/EC on waste management (see summary) and Regulation (EU) 2019/1020 on market surveillance and compliance of products (see summary). It repeals Directive 2006/66/EC on the disposal of spent batteries (see summary) from 30 June 2027.
The Regulation mandates minimum recycled content requirements for industrial batteries with a capacity greater than 2 kWh, excluding those with exclusively external storage, EV batteries, and SLI batteries. The minimum percentage shares of the recycled content are as follows:
According to Article 55 of the Battery Regulation, producers, or their authorised representatives, should register in the register of producers of the EU member state where they sell their products.
